As a landlord What can I do here?
I rented a house for 3 people own a couple and their friend. now the friend wants to back his year long lease (it's only been 3 months) is the third person, as it has always paid his rent late. is establishing a list of things that are lies. ie, the house was unsanitary, when he moved, my possessions were still in the house when she moved (ie, table and patio furniture, what I asked them if they wanted and they said they did) and that the maintenance of the pool not be provided (that is) What I do in this position. should sue her? I live in Orlando, FL if anyone out there who knows flordia's legal system. THANX! enjoy the 10 points, who gives me much needed good advice!
You say "his year long term lease", so I'm assuming that the 3 people signed a lease, including the one that wants out. A unless you agree to remove that individual who wants to quit the lease, all three of the tenants are responsible for complying with the lease if a person leaves or not. Unless the lease specifically states that each person will be responsible for only one third of the obligations of the lease (which I doubt), the three tenants on the hook legally. Make sure the other two tenants understand that he expects the full-time and monthly payment all regardless that one of three left. His appeal, whether to meet the people that the 3rd part of the rent, is to sue that person for any shortfall. Perhaps the suggestion of that the remaining two to find another roommate is in order, especially if it is clear that they would have difficulties to cover the rent on their own. In any case, the lease is in the three … if they are alive or not there … til the expiration of the lease. Good Luck!
